Wills, Probate and Deceased Estates

The future favours a prepared mind.

If you take the time now to make a legally binding Will, you can save your family time and money when you are gone. We can can help by:

  • Searching and investigating the availability of Trademarks for use and registration
  • Filing and prosecuting trademark applications before the Australian Trademarks Office
  • Assessing the risk of infringement of existing Trademarks
  • Advice on licensing and assigning Trademarks

At the same time as considering your Will, we strongly recommend that you also put in place plans for any future incapacity by having us prepare a Power of Attorney and Advance Health Directive. These documents will ensure that if you somehow become unable to make decisions about your finances, your medical treatment or living arrangements then the person or persons who you trust to make these decisions can do so unhindered.

Probate and Deceased Estates

Our firm can help you to take the stress out of the administration of a deceased estate. We assist Executors (where there is a will) and Administrators (where there is no will) to ensure that they comply with all legal obligations.

It is an important responsibility to administer a deceased estate properly and we make sure that you are guided through every step of the process, from understanding the will, compiling an inventory of estate assets and liabilities, applying for a grant of probate (where there is a will) or a grant of letters of administration (where there is no will), to paying estate debts, ensuring tax obligations are met and finally distributing the estate to the will maker’s chosen beneficiaries.

Our philosophy is that communication is vital, particularly following the loss of a loved one. We aim to keep you and the beneficiaries informed of the status of the administration. Our costs are based on the amount of work required, not on the value of the estate assets.
